Please read these Terms of Service carefully before using the Cipher Trade platform. These terms govern your use of our cryptocurrency exchange services and constitute a binding legal agreement.
1. Acceptance of Terms
By accessing or using the Cipher Trade platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Cipher Trade, Inc.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is not available to residents of certain jurisdictions where cryptocurrency trading is prohibited by law.
3. Account Registration
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
4. Trading and Orders
All trades executed on the platform are final. Cipher Trade does not guarantee the execution of any order at any specific price or time. Market conditions may result in orders being executed at prices different from those displayed. You acknowledge that cryptocurrency trading involves significant risk and that you may lose some or all of your invested capital.
5. Fees
Cipher Trade charges fees for certain transactions, including but not limited to trading fees, withdrawal fees, and network fees. Current fee schedules are available on our Fees page. We reserve the right to modify our fee structure at any time with reasonable notice to users.
6. Prohibited Activities
You agree not to engage in any of the following activities: market manipulation, wash trading, spoofing, or any other fraudulent trading practices; using the Service for money laundering or financing of illegal activities; attempting to gain unauthorized access to any part of the Service; using automated tools to access the Service without our express written permission; or violating any applicable laws or regulations.
7. Security
You are responsible for maintaining the security of your account, including enabling two-factor authentication. Cipher Trade employs industry-standard security measures but cannot guarantee absolute security. You agree to notify us immediately of any unauthorized access to your account.
8. Risk Disclosure
Cryptocurrency markets are highly volatile and speculative. The value of digital assets can fluctuate dramatically in short periods. Past performance is not indicative of future results. You should only invest funds that you can afford to lose entirely. Cipher Trade does not provide investment advice, and nothing on the platform constitutes a recommendation to buy or sell any asset.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Cipher Trade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the platform and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
